Actually he does have a say in whether or not they are handed over to Congress. He can claim executive privilege, but it is up to Biden to determine whether to honor that or not. Biden has decided that the documents are necessary for the investigation for the good of the country so he is not honoring Trump’s demand for executive privilege.
