Actually, it should be 13 justices because you don't want tied decisions. That's why Amy Coney Barrett's nomination was rammed through. The fear was that if Trump lost and contested the election, the 8 justices might split evenly. They needed 9 to prevent that. Ironically, only one election lawsuit made it to the Supreme Court and the Court refused to hear it.
