Federalist Society Members Say That Trump Is Ineligible to Be President
He is constitutionally barred from the presidency using an originalist interpretation
I keep looking for hope that Trump will somehow be prevented from winning in 2024 and I may have found it in the Federalist Society of all places.
Two law professors and constitutional scholars who are active members of the Federalist Society took a deep dive into the origins and interpretations of Section 3 of the 14th Amendment (passed after the Civil War) and determined that Trump is ineligible to run for office.
Section 3 says that anyone who has sworn an oath to uphold the Constitution and then goes on to engage in insurrection or rebellion against the country or gives aid and comfort to the enemies of the country is barred from holding office.
The only way such a person could hold office again is if 2/3 of the Congress grants them amnesty for their actions.
So how did they prove Trump engaged in insurrection? Even Jack Smith hasn’t charged Trump with engaging in insurrection.
