Has the Equal Rights Amendment Been Ratified?

According to two members of Congress, it is already the law of the land

I know that I write about a lot of grim events, but I do try to find silver linings. Like the lawsuits to overturn state abortion bans because they violate women’s religious beliefs.

Today, I am happy to report another positive event. Sen. Kirsten Gillibrand (D-N.Y.) and Rep. Cori Bush (D-Mo.) are trying to resurrect the Equal Rights Amendment (ERA) to give abortion a constitutional basis. And they are doing it in a very novel way.

According to Gillibrand and Bush, the amendment has already been ratified and is the law of the land. I know, we were all taught that it is dead in the water, just a few states short of ratification. But they are arguing that enough states have ratified it, even though the last votes came after the deadline for approval had passed.

Because … brace yourself … the deadline is unconstitutional.

I know that that is a lot to take in, so let’s have a quick refresher on the history of the ratification of the ERA. The ERA was introduced in Congress in 1923. At that time, it was a very radical idea, so it didn’t go anywhere. Fast forward about 50 years, and the amendment was re-introduced…
