Is Legalized Contraception in Danger?
It could be overturned on the same basis that Roe was overturned
Remember when the Dobbs decision, the one that overturned Roe v. Wade, was handed down and it was Clarence Thomas’ concurrence that had me really worried? Well, it looks like I wasn’t the only one who is worried.

First, let’s briefly review Thomas’ concurrence. He said that since the Dobbs decision was based on the fact that there is no right to privacy spelled out in the 14th Amendment of the Constitution, other decisions that were decided on the same basis should also be overturned.
He specifically mentioned three out of the four decisions that, in his view, should be overturned: legalized contraception, legalized gay sex, and legalized gay marriage. He left out legalized interracial marriage most likely because he is married to a woman of a different race.
Hypocrite much?
While we have all been fighting the good fight to keep abortion legal on a state-by-state basis, Democrats and reproductive rights advocates have been doing the same for legalized contraception.
