SCOTUS Rejects the Independent State Legislature Theory
We can all breathe a little easier now
It’s safe to exhale now. We’ve dodged a bullet. The Supreme Court has released its ruling on Moore v. Harper and ruled against the ridiculous “independent state legislature” theory.
Just a little background. As a result of the 2020 census, North Carolina gained a seat in the House, so the state legislature got busy redrawing Congressional districts. Being Republicans, they drew the districts in such a way that out of 14 districts, 10 would be Republican and only 4 would be Democrat.
The problem? North Carolina in 50–50 Republican and Democrat. Naturally, the issue ended up in the court and the state supreme court said “no freaking way” and drew a map that was more equal. That map was used in the 2022 midterm elections.
But it was only temporary cuz the state legislature said “way” and started waving the Constitution around.
Now the Constitution says
“The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.”
