Trump’s Legal Team Has Requested a Mistrial
They are setting the groundwork for an appeal
Trump has been sued so many times, that his trial strategies are well-known and completely predictable. So, no one was surprised when his lawyer, Joe Tacopina, delivered an 18-page letter to Judge Lewis Kaplan, the presiding judge in E. Jean Carroll’s case against Trump, requesting a mistrial because of his supposed bias against Trump.
And what was that bias?
· The judge did not allow Tacopina to question Carroll about why she didn’t try to get a copy of the security tape that would have shown what happened in the dressing room where the alleged rape occurred.
· The judge limited Tacopina’s questioning of Carroll as to why she didn’t scream or go to the police.
· Kaplan’s statement that Trump was “sailing in harm’s way” after Eric Trump posted a tweet that Carroll’s defense is being funded by LinkedIn co-founder Reid Hoffman. The judge was alluding to his warning about jury tampering by Trump.
These, and other accusations, were characterized in the letter as “pervasive unfair and prejudicial rulings.”
